Stop Back Pain: End Chronic Back and Neck Pain

Am i entitled to military disability?

Question by michael: Am i entitled to military disability?

hi, i was pondering if any individual may well be ready to help me out with this, as im sort of running quick on time to get it done. I feel I injured my back even though in korea, its well documented that ive had back discomfort ever because then but could by no means pinpoint what in fact induced it, considering that I by no means had any main accident. They’ve place me via just about every thing they could given that then which includes many temporary profiles, physical treatment and finally they put me on a long term profile for “persistent back discomfort” correct prior to I had an MRI, when they eventually found that I have two herniated disks in my reduce back. That was right prior to I deployed here to Iraq. Im at present stop lossed and returning to the states up coming month. I will have 60 days left in the army when we return. Im not sure exactly where to start off or if I will be entitled to disability.

Sounds like you will be entitled to at least 70%. Get the ball rolling on the paperwork!

  • Make sure you make a copy of your medical records so they don’t get “lost”. You will apply for disability with the VA. It should be covered in your separation briefings.

  • Yes, you sound like a candidate for partial disability, at the very least. When you return stateside, check in with the medical people when you get to your new duty station. With only 60 days of active duty left, you will be given a separation from duty physical. Make sure then, that you maximize the problems associated with this condition.

The VA also has the power to review your case, in the event the army doesn’t cooperate, so be prepared to follow that avenue in the event it isn’t settled before you separate from service.

Remember, the squeaky wheel gets the grease ! So just keep chipping away with the VA if the army gets ugly and fails to cooperate ! Good luck !

  • Yes. “Disability compensation is a benefit paid to a veteran because of injuries or diseases that happened while on active duty, or were made worse by active military service.” http://www.vba.va.gov/bln/21/compensation/index.htm

Make sure to attend the VA brief at your post to get the skinny. *stomps foot repeatedly to ensure you are getting the point* :)

Basically, there will be some medical history forms (DD 2697, DD 2807) for you to fill out at your final physical. This is the time to complain about everything that was ever wrong with you. However, it must be substantiated by your medical records.

Also, there are organizations like AMVETS or VFW that will screen your records and help you fill out the necessary paperwork. Good Luck!
